Welcome to Hiliree. These Terms of Service (“Terms”) govern your access to and use of the Hiliree mobile application, website, features, content, tools, and related services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
These Terms should be read together with Hiliree’s Privacy Policy, Cookies Policy, Child Safety Standards, Third-Party Tools and Open-Source Components notice, Community Guidelines, and any other legal notices or policies made available by Hiliree.
Introduction
Hiliree is a family-connection platform that enables users to build family trees, connect with relatives, communicate, share memories, organize family events, explore family insights, and preserve family information across generations.
The Service may include features such as family tree creation, Handshake Invites, profiles, Moments, chats, voice calls, video calls, events, map and location features, Hiliree Insights, notifications, and other family-history or family-connection tools.
These Terms apply to all users, visitors, and anyone who accesses or uses the Service.
Definitions
For purposes of these Terms:
- “Hiliree,” “we,” “us,” or “our” means Hiliree, its owners, affiliates, officers, employees, contractors, service providers, representatives, and authorized agents.
- “User,” “you,” or “your” means any individual who accesses or uses the Service.
- “Service” means the Hiliree mobile application, website, features, tools, content, software, and related services.
- “Content” means any information, data, text, images, videos, audio, messages, family tree information, profile details, location information, comments, Moments, memories, events, or other materials submitted, uploaded, posted, transmitted, generated, displayed, or made available through the Service.
- “User Content” means Content submitted, uploaded, posted, shared, or provided by users.
- “Generated Content” means automated, technology-assisted, interpretive, reflective, or personalized content provided through the Service, including Hiliree Insights, naming context, cultural references, prompts, summaries, recommendations, or family-history reflections.
- “Hiliree Insights” means reflective family history, naming, cultural, or family-pattern insights designed to spark curiosity, connection, storytelling, and family conversation.
- “Handshake Invite” means Hiliree’s mutual connection process that allows users to connect a real Hiliree account with a family profile or family relationship after acceptance.
- “Minor” means any person under the age of 18 or any other age defined as a child or minor under applicable law.
Eligibility
You must be at least 13 years old or meet the minimum age required in your jurisdiction to use Hiliree.
If you are under 18 or the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian.
By using the Service, you represent and warrant that:
- You meet all applicable age and eligibility requirements.
- You have the legal capacity to agree to these Terms.
- Your use of the Service complies with applicable laws and these Terms.
- If you use the Service on behalf of another person or organization, you have the authority to do so.
Hiliree may refuse access, suspend accounts, or terminate accounts if eligibility requirements are not met or if use of the Service may violate the law, platform rules, or these Terms.
User Accounts
To use certain features, you may need to create an account and provide accurate, current, and complete information.
You agree to:
- Provide accurate and complete account information.
- Keep your account information updated.
- Maintain the confidentiality of your login credentials.
- Use reasonable security measures to protect your account and device.
- Notify Hiliree if you suspect unauthorized access or misuse.
- Be responsible for the activity that occurs under your account.
You may not:
- Create an account using false, misleading, or unauthorized information.
- Impersonate another person.
- Create accounts for abusive, fraudulent, exploitative, or unlawful purposes.
- Sell, transfer, assign, or share your account without authorization.
- Use another person’s account without permission.
Hiliree may suspend, restrict, or terminate accounts that provide false information, violate these Terms, misuse the Service, or create safety, privacy, security, or legal concerns. To use certain features, you must create an account and provide accurate and complete information.
You agree to:
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorized use
- Be responsible for all activities under your account
Hiliree may suspend or terminate accounts that provide false information or violate these Terms.
Privacy
Your privacy matters to us. Hiliree’s Privacy Policy explains how we collect, use, store, disclose, and protect personal information.
By using the Service, you acknowledge that Hiliree processes information as described in the Privacy Policy.
The Privacy Policy, Cookies Policy, and related legal notices are incorporated into these Terms by reference.
Family Information and Living Individuals
Hiliree allows users to add, organize, and share family information, including information about relatives, living individuals, deceased relatives, minors, and family relationships.
You are responsible for ensuring that you have appropriate rights, permissions, consent, family context, or lawful basis to upload, add, invite, share, or contribute information about other people.
You agree to use discretion and respect the privacy, consent, dignity, and preferences of living individuals represented within the Service.
You should be especially careful when adding or sharing:
- Information about minors.
- Location information.
- Contact information.
- Photos or videos of others.
- Sensitive family matters.
- Health, legal, financial, religious, or highly private information.
- Information that could expose, embarrass, endanger, or harm another person.
Hiliree does not independently verify all family tree information, relationships, dates, locations, or user-submitted family history. Users are responsible for the accuracy and appropriateness of the information they submit.
Handshake Invites and Family Connections
Hiliree’s Handshake Invite feature is designed to help users connect with real family members through mutual approval.
To connect with a family member, users may need to add the person to their family tree, share an invite link, and complete the acceptance process.
You agree that:
- You will not send misleading, unwanted, abusive, fraudulent, or unauthorized invitations.
- You will not impersonate relatives or misrepresent relationships.
- You will not use Handshake Invites to harass, stalk, manipulate, exploit, or endanger others.
- You are responsible for ensuring that the relationship information you create or share is appropriate and accurate to the best of your knowledge.
Hiliree may restrict, disable, or remove invitations or connections that appear abusive, fraudulent, unsafe, unauthorized, or inconsistent with these Terms.
User Content
You retain ownership of the User Content you submit, upload, post, or share through the Service.
By submitting User Content, you grant Hiliree a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, transmit, display, modify, adapt, distribute, and use your User Content solely as necessary to operate, provide, secure, maintain, personalize, moderate, and improve the Service.
This license includes the ability to:
- Display User Content to users based on your settings and sharing choices.
- Store and back up User Content.
- Process User Content to provide family tree features, Moments, chats, events, location features, Hiliree Insights, and other Service functionality.
- Use technical systems to support moderation, safety, security, analytics, and reliability.
- Generate previews, thumbnails, summaries, or related Service experiences where applicable.
This license ends when your User Content is deleted from the Service, except where retention is necessary or permitted for backup, legal compliance, dispute resolution, safety, security, enforcement, or legitimate operational purposes.
Your Content Warranties
You represent and warrant that:
- You own or have permission to upload, submit, or share your User Content.
- Your User Content does not infringe, misappropriate, or violate the rights of others.
- Your User Content does not violate privacy, publicity, intellectual property, child safety, or other legal rights.
- Your User Content is not unlawful, harmful, abusive, exploitative, defamatory, hateful, harassing, threatening, or otherwise prohibited by these Terms.
- You have appropriate permission or authority to share content involving living individuals, minors, photos, videos, contact details, or location information.
Hiliree is not responsible for User Content uploaded, submitted, or shared by users. Hiliree may remove, restrict, disable, or report User Content that appears to violate these Terms, applicable law, platform rules, or user safety expectations.
Generated and Interpretive Content
Certain features within Hiliree may provide automated, technology-assisted, interpretive, reflective, or personalized family-history insights, naming context, cultural references, summaries, prompts, or recommendations, including Hiliree Insights.
Generated Content is provided for informational, educational, entertainment, and family-conversation purposes only.
Hiliree Insights are designed to spark curiosity, storytelling, reflection, and family connection. They may be based on general name meaning, cultural context, naming traditions, historical interpretation, interaction patterns, preferences, or user-provided family information where available.
Generated Content should not be interpreted as:
- Verified genealogy research.
- Ancestry verification.
- DNA analysis.
- Ethnic determination.
- Religious determination.
- Legal documentation.
- Medical advice.
- Psychological assessment.
- Financial advice.
- Genetic analysis.
- Certified historical interpretation.
- Identity verification.
- A definitive conclusion about a person or family.
Hiliree does not guarantee that Generated Content is accurate, complete, verified, or applicable to any individual user, family, ancestry, ethnicity, culture, religion, region, or historical record.
Meanings, interpretations, traditions, and family stories may vary across families, cultures, regions, languages, and communities.
Users remain responsible for independently evaluating and verifying any information they choose to rely upon.
No Professional Advice
Hiliree does not provide legal, genealogical, medical, psychological, religious, financial, genetic, tax, historical, or other professional advice.
The Service is designed to support family connection, storytelling, memory preservation, personal organization, and family-history exploration.
You should not rely on the Service, Generated Content, Hiliree Insights, family tree entries, or user-submitted content as a substitute for professional advice, official records, certified genealogy research, legal documentation, medical guidance, financial advice, or other professional services.
Automated Processing and Personalization
Hiliree may use automated systems or technology-assisted processing to support:
- Family insights.
- Hiliree Insights.
- Personalization.
- Recommendations.
- Preference-based experiences.
- Safety and moderation.
- Fraud prevention.
- Security monitoring.
- Analytics.
- App performance.
- User experience improvements.
Hiliree does not use automated processing to make legal, financial, medical, employment, insurance, credit, housing, or similarly significant decisions about users.
Automated or personalized experiences are intended to improve usability, relevance, connection, safety, and engagement within the Service.
Third-Party Tools and Service Providers
Hiliree may use trusted third-party service providers, infrastructure providers, technology tools, communication providers, analytics providers, storage providers, payment processors, app distribution platforms, security services, and operational tools to provide, secure, maintain, personalize, and improve the Service.
These providers may support features such as:

Hiliree does not publish a complete list of all internal systems, infrastructure providers, vendors, or security tools in order to protect the security, reliability, and integrity of the Service. However, Hiliree aims to provide meaningful transparency about the categories of providers and technologies used.
Your use of certain features may also be subject to third-party terms, privacy policies, platform policies, app-store rules, or provider requirements.
Open-Source Components
Hiliree may use open-source software components that support the operation, performance, security, design, or reliability of the Service.
Each open-source component is used in accordance with its applicable license.
Where required, attribution, copyright notices, license terms, or related notices may be provided:
- Within the app.
- Within website documentation.
- In a dedicated Open-Source Notices section.
- In product documentation.
- Upon reasonable request, where appropriate.
Use of the Service does not grant users ownership of Hiliree’s software, source code, systems, infrastructure, proprietary designs, confidential information, branding, or underlying technology.
All rights not expressly granted are reserved by Hiliree or the respective rights holders.
User Responsibilities
When using Hiliree, you agree to:
- Use the Service only for lawful purposes.
- Provide accurate information about yourself where required.
- Add family information carefully and respectfully.
- Respect the privacy and rights of others.
- Obtain permission where needed before sharing content involving others.
- Use available privacy and safety settings responsibly.
- Keep your login credentials secure.
- Comply with these Terms and all applicable policies.
- Report unsafe, abusive, exploitative, or unlawful content where appropriate.
You agree not to:
- Upload content that is harmful, offensive, defamatory, violent, hateful, abusive, exploitative, sexually explicit, unlawful, or otherwise prohibited.
- Misuse of personal information of family members or other users.
- Harass, threaten, stalk, intimidate, or harm others.
- Impersonate another person.
- Create fake profiles or misleading family relationships.
- Attempt to access systems without authorization.
- Engage in scraping, reverse engineering, data extraction, or copying of the platform.
- Upload malicious code, viruses, automated scripts, bots, or disruptive tools.
- Interfere with Service security or operations.
- Use the Service to exploit, groom, manipulate, endanger, or harm minors.
- Use the Service for unlawful, fraudulent, deceptive, or abusive purposes.
Hiliree may remove content, restrict features, suspend accounts, or terminate accounts for violations.
Prohibited Activities
You agree not to use the Service to:
- Harass, threaten, abuse, exploit, or harm others.
- Upload, share, request, or distribute unlawful content.
- Upload malicious code, viruses, malware, bots, or automated scripts.
- Misuse of personal information of family members or users.
- Create fake, misleading, or impersonating profiles.
- Engage in unauthorized data harvesting, scraping, extraction, indexing, or crawling.
- Attempt to disrupt, bypass, or compromise platform security or operations.
- Reverse engineer, copy, modify, decompile, or derive source code from the Service except where legally permitted.
- Use the Service for spam, phishing, fraud, scams, or deceptive activity.
- Upload or share content that violates intellectual property rights.
- Share private information without authorization.
- Use the Service to stalk, monitor, or track others without lawful authority.
- Upload or share content involving minors in an unsafe, exploitative, sexualized, or unlawful manner.
- Use the Service to groom, solicit, traffic, exploit, or endanger minors.
- Use the Service for hate, violence, extremism, or harassment.
- Circumvent account restrictions, bans, or safety controls.
- Use automated tools to access the Service without permission.
- Use Hiliree’s name, branding, or content without authorization.
- Interfere with or disrupt the Service or servers.
Violations may result in content removal, account restriction, suspension, termination, reporting to authorities, or legal action.
Child Safety
Hiliree has a zero-tolerance policy for child sexual abuse and exploitation.
Users may not upload, share, request, create, distribute, store, promote, or facilitate:
- Child sexual abuse material.
- Child sexual abuse and exploitation.
- Sexual content involving minors.
- Grooming, sextortion, trafficking, solicitation, coercion, or predatory behavior involving minors.
- Any content or conduct that sexualizes, exploits, endangers, harms, or targets minors.
Users must follow Hiliree’s Child Safety Standards.
Hiliree may remove content immediately, suspend or terminate accounts, restrict access, preserve relevant information, and report matters to appropriate authorities, law enforcement, child protection organizations, or reporting hotlines where required or appropriate under applicable law.
If a child is in immediate danger, contact local emergency services or law enforcement immediately.
User-Generated Content, Reporting, and Moderation
Hiliree may include user-generated content and user-to-user interaction features, including profiles, family trees, Moments, photos, videos, messages, chats, calls, comments, events, locations, invites, and other content or interactions.
Users may report content, accounts, messages, profiles, Moments, family tree information, Hiliree Insights, or conduct they believe violates these Terms, Hiliree’s policies, privacy expectations, child safety standards, or applicable law.
Where available, users may also block, restrict, unlink, disconnect, remove, or manage interactions with other users.
Hiliree may review reports and may take action, including:
- Removing or restricting content.
- Suspending or terminating accounts.
- Restricting features.
- Disabling invite links.
- Limiting contact between users.
- Preserving information where required or permitted.
- Reporting matters to authorities where required or appropriate.
- Taking other action necessary to protect users, minors, Hiliree, or the public.
Hiliree is not obligated to monitor all content or interactions, and no moderation system can detect every violation. However, Hiliree may use human review, automated tools, user reports, technical safeguards, and policy enforcement processes to support safety and compliance.
Location and Map Features
Hiliree may allow users to add, share, or view location-related information, including profile locations, map views, event locations, current locations, pinned locations, or meaningful family places.
You are responsible for choosing what location information to share and with whom.
You should be careful when sharing location information involving:
- Minors.
- Home addresses.
- Schools.
- Workplaces.
- Routine locations.
- Sensitive family locations.
- Deceased relatives’ final resting places.
- Any location that could create privacy or safety concerns.
Hiliree may restrict or remove location-related content if it appears unsafe, unauthorized, unlawful, or inconsistent with these Terms.
Payments, Purchases, and Subscriptions
Hiliree may offer paid features, subscriptions, contributions, donations, gifts, premium services, or other paid functionality now or in the future.
Payments may be processed by third-party payment processors, mobile app stores, or financial service providers.
By making a purchase, you agree to the pricing, billing terms, refund policies, subscription terms, app-store rules, and payment-provider terms presented at the time of purchase.
Hiliree does not intentionally collect or store full payment card numbers where third-party payment processors or app stores are used.
Unless otherwise required by law or platform rules, purchases may be non-refundable.
Subscriptions may automatically renew unless canceled according to the applicable app-store, payment-provider, or Hiliree cancellation process.
If Hiliree does not currently offer paid features in your region or version of the Service, this section applies only if and when such features become available.
Intellectual Property
Hiliree and its licensors own all rights, title, and interest in and to the Service, including software, designs, interfaces, graphics, logos, trademarks, service marks, trade names, features, functionality, content, systems, technology, and proprietary materials, excluding User Content.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, reverse engineer, or exploit any part of the Service except as expressly permitted by these Terms or applicable law.
Hiliree grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for lawful personal and family-connection purposes, subject to these Terms.
No rights are granted except those expressly stated in these Terms.
Feedback
If you submit feedback, ideas, suggestions, improvements, or recommendations to Hiliree, you grant Hiliree the right to use them without restriction or compensation to you.
Hiliree may use feedback to improve, modify, develop, or commercialize features, products, services, or business operations.
Account Deletion and Data Removal
You may delete your account through the app, where available, or by contacting Hiliree as described in the Privacy Policy.
Deleting your Hiliree account is different from deleting a family member profile from a family tree.
When your account is deleted, personal information associated with your account may be deleted, anonymized, or retained only where necessary or permitted for:
- Legal compliance.
- Security.
- Fraud prevention.
- Dispute resolution.
- Backup recovery.
- Enforcement of Terms.
- Audit or accounting obligations.
- Protection of rights or safety.
- Operational requirements permitted by law.
Family member profiles, memories, or content created or shared by other users may remain subject to those users’ account settings, rights, and legal obligations.
If Hiliree uses a pending deletion process, deletion may not be finalized immediately and may follow the timeframe described in the app or Privacy Policy.
Termination
Hiliree may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, if:
- You violate these Terms.
- You violate Hiliree’s policies.
- You misuse the Service.
- Your conduct creates a legal, privacy, security, or safety risk.
- Your behavior risks the safety or operation of the platform.
- Your account appears fraudulent, abusive, inactive, unauthorized, or compromised.
- Required by law, platform rules, or third-party provider requirements.
You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
Upon termination, your right to access or use the Service will stop immediately. Certain provisions of these Terms will survive termination, including provisions relating to ownership, licenses, disclaimers, liability limits, indemnity, dispute resolution, and any terms that by nature should survive.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, Hiliree disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, and uninterrupted operation.
Hiliree does not guarantee that:
- The Service will be error-free.
- Access will be uninterrupted.
- The Service will be secure at all times.
- Content will be complete, accurate, or reliable.
- User-submitted family information will be accurate.
- Hiliree Insights will be verified or applicable to your family.
- The Service will meet your expectations.
- Third-party services will remain available or function without interruption.
- All harmful, inappropriate, or unlawful content will be detected or removed.
You use the Service at your own discretion and risk.
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, Hiliree and its owners, affiliates, officers, employees, contractors, agents, licensors, and service providers will not be liable for:
- Loss of data.
- Lost profits.
- Lost revenue.
- Loss of goodwill.
- Business interruption.
- Personal or emotional distress.
- Family disputes.
- Incorrect family information submitted by users.
- User reliance on Generated Content or Hiliree Insights.
- Unauthorized access to your account caused by factors outside Hiliree’s reasonable control.
- Indirect, incidental, consequential, special, exemplary, or punitive damages.
- Third-party service failures.
- Service interruptions.
- User-generated content.
- Actions of other users.
- Content shared without permission by users.
- Errors, inaccuracies, omissions, or delays in content.
- Device, app-store, network, or platform issues outside Hiliree’s reasonable control.
If liability cannot be excluded, Hiliree’s liability will be limited to the smallest amount permitted under applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Hiliree and its owners, affiliates, officers, employees, contractors, agents, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use or misuse of the Service.
- Your violation of these Terms.
- Your User Content.
- Your violation of another person’s rights.
- Your sharing of information about relatives, living individuals, minors, or third parties.
- Your violation of privacy, publicity, intellectual property, child safety, or data protection rights.
- Your unlawful, unsafe, or abusive conduct.
- Your reliance on or misuse of Generated Content.
- Your violation of applicable law.
Hiliree reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with Hiliree’s defense.
Dispute Resolution
Informal Resolution
Before filing a formal claim, you agree to contact Hiliree at support@hiliree.com and attempt to resolve the dispute informally.
Hiliree will make reasonable efforts to review and respond to disputes submitted through support channels.
Governing Law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules, except where applicable consumer protection laws require otherwise.
Nothing in these Terms limits any non-waivable consumer rights that may apply under the laws of your jurisdiction.
Arbitration Requirement
To the fullest extent permitted by law, disputes arising out of or relating to these Terms or the Service must be resolved through binding individual arbitration in New Jersey under the rules of the New Jersey State Board of Mediation or a comparable arbitration body.
If the named arbitration body is unavailable or inappropriate for the dispute, the parties may agree to a comparable arbitration provider, or a court of competent jurisdiction may appoint one.
Class Action Waiver
To the fullest extent permitted by law, you and Hiliree agree that disputes must be resolved individually and not as part of a class, collective, consolidated, or representative action.
Exceptions
Nothing in this section prevents either party from seeking emergency injunctive relief, filing in small claims court where permitted, or bringing claims that cannot legally be required to be arbitrated.
App Stores and Platform Terms
If you download Hiliree from the Apple App Store, Google Play Store, or another app distribution platform, your use of the Service may also be subject to that platform’s terms, policies, and rules.
The app store or platform provider is not responsible for the Service except as required by applicable platform rules or law.
You are responsible for complying with applicable device, operating system, app-store, and platform requirements.
Changes to the Service
Hiliree may modify, update, suspend, discontinue, replace, remove, or limit any part of the Service at any time.
Hiliree may add, remove, or change features to improve security, performance, compliance, user experience, or functionality.
We are not liable for modifications, interruptions, suspensions, or discontinuation of the Service, except where prohibited by law.
Changes to These Terms
Hiliree may update these Terms from time to time to reflect changes in:
- Law.
- Regulations.
- Platform requirements.
- Technology.
- Service features.
- Data practices.
- Security practices.
- Business operations.
The “Last Updated” date will reflect the latest version.
Material changes may be communicated through the app, website, email, or other appropriate channels where required.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms where permitted by law.
If you do not agree to the updated Terms, you should stop using the Service.
Miscellaneous
Severability
If any part of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver
Failure to enforce any provision of these Terms does not waive Hiliree’s right to enforce that provision later.
Assignment
You may not assign or transfer these Terms or your rights under them without Hiliree’s prior written consent.
Hiliree may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction.
Entire Agreement
These Terms, together with the Privacy Policy, Cookies Policy, Child Safety Standards, Third-Party Tools and Open-Source Components notice, Community Guidelines, and other applicable legal notices, form the entire agreement between you and Hiliree regarding the Service.
Headings
Headings are for convenience only and do not affect the interpretation of these Terms.
Force Majeure
Hiliree is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, internet outages, labor disputes, war, terrorism, government actions, cyberattacks, provider failures, or platform outages.
Language
These Terms may be translated for convenience. If there is a conflict between translations and the English version, the English version controls unless prohibited by applicable law.
